Kelvedon Neighbourhood Plan - Adopted July 2022

At a meeting of The Council on the 25th July 2022 it was agreed that The Kelvedon Neighbourhood Plan should be “made” and become part of the development plan for Braintree District.

Previously...

Braintree District Council received an application from Kelvedon Parish Council to designate a neighbourhood area under S61g of the Town and Country Planning Act 1990 (as amended) in January 2015. The application proposed that the neighbourhood area would cover Kelvedon Parish.

In accordance with regulations set out in The Neighbourhood Planning (General) Regulations 2012, Braintree District Council consulted on the proposed neighbourhood area.

The Neighbourhood Plan application was agreed by Cabinet on 30th March 2015

The Neighbourhood Plan was submitted under Regulation 15 to Braintree District Council in February 2021.

Braintree District Council undertook a Regulation (Reg) 16 Consultation between 4th June 2021 and Friday 16th July 2021 .

  • Kelvedon Library Aylett's Foundation School, Maldon Road, Kelvedon CO5 9BA

Regulation 18 – In August 2021 Braintree District Council in consultation with Kelvedon Parish Council appointed the independent examiner Mr Tony Burton to examine the Kelvedon Neighbourhood Plan.

The Examiner's report on The Kelvedon Neighbourhood Plan was received in November 2021.

Following the report, Braintree District Council confirmed that The Kelvedon Neighbourhood Plan (The Plan) meets the basic conditions and other legislative requirements, and proceeded to a Neighbourhood Planning Referendum on 3rd March 2022.

A referendum on the Kelvedon Neighbourhood Plan was held on 3rd March 2022, 

Declaration of Results

The referendum showed that 94% of those who voted were in favour of the plan, however a legal challenge was issued by developer Parker Strategic Land Ltd who sought to overturn our decision to submit the Neighbourhood Plan to referendum and thereby stop the Neighbourhood Plan being adopted by Braintree District Council.

In April, a High Court Judge dismissed all grounds put forward and ordered them to pay the Council’s costs.

The developer then sought to appeal the decision of the High Court, however permission was refused.

Regulation 19 - The Kelvedon Neighbourhood Plan was considered by Council on 25th July 2022.
