Apply for a new Premises licence

How to apply for a premises licence

You can apply online here.

To apply for a premises licence, you will need to:

  • download the application form on GOV.UK

  • upload your completed application form on GOV.UK

  • submit a plan of the premises

  • submit an operating schedule

  • give details of your Designated Premises Supervisor

  • pay the correct fee

You can also download and print the application form from GOV.UK. If you decide to download and print your application, you will need to return it to us by post or in person.

Timescales

Once we receive your application, we will:

  • acknowledge it within three working days

  • hold a consultation for 28 days, allowing for representations

  • carry out site visits

You should allow at least two months from the date you apply until we determine if we are going to grant the licence.

Approval

We will give you express notice of whether or not we have granted your licence. We can only notify you once we have carried out all of our site visits.

You cannot deem that we have granted your licence if we do not make a decision within a specific time.

If we receive any representations, we will take the application to the Licensing Committee for councillors to consider. We will then notify you of their decision.

If we do not grant your licence, we will not refund your fee.

If we do not receive any representations, we will grant the licence.

If we grant your licence, it will be valid unless you surrender it or we revoke it.

Although you do not need to renew your licence each year, you will need to pay an annual fee. You will need to pay the fee on the same date as when we granted your licence.

Fees

The fee you will need to pay depends on the rateable value of your premises.

£87,001 to £125,000 £450 £320
£125,001 and over £635 £350

The application fee is £900 for premises with a rateable value of £87,001 to £125,000 if the premises is primarily or exclusively selling alcohol for consumption on the premises.

The application fee is £1,905 for premises with a rateable value of £125,001 and over if the premises is primarily or exclusively selling alcohol for consumption on the premises.

You will not need to pay a fee if you will not be selling alcohol or providing late night refreshment, and the premises is:

  • an educational institution

  • a church hall, chapel hall or similar building

  • a village hall, parish hall or similar building

Annual fees

Once we have granted your licence, you will need to pay the fee every year. We will send you a reminder letter about your fee. 

If you fail to make the payment, we may suspend your licence.

Pay online

This is our preferred method of payment. You can pay your fee online through GOV.UK.

To pay your fee online you will need:

  • your debit or credit card
  • your reference number. You can find this on the reminder letter we send you
  • the amount you want to pay

Pay by phone

To pay your fee by phone toy need to email our Licensing team with:

  • Your name
  • your daytime phone number
  • your reference number. You can find this on the reminder letter we send you
  • the amount you want to pay

We will telephone you within one working day to collect the payment. We will email you a receipt, after we have taken the payment.

Pay by post

You can send a cheque to our Licensing team to pay your fee.

You need to make your cheque payable to Braintree District Council, with your reference number clearly written on the reserve side.

Appeal a decision

You can appeal to the magistrates court within 21 days of our decision if you are:

  • an unsuccessful applicant
  • an objector
