Extract from Section 106 Agreement for properties at Braintree Road, Great Bardfield

Local connection shall be determined by applying the following criteria in the following priority order:

  1. Either, the prospective occupier of an Affordable Housing Dwelling lives in the Parish of Great Bardfield and has done so continuously for a minimum period of five years immediately prior to making an application for an Affordable Housing Dwelling, or, the prospective occupier of an Affordable Housing Dwelling has lived in the Parish of Great Bardfield for not less than five years during the immediately preceding ten year period.
  2. The prospective occupier of an Affordable Housing Dwelling is employed full time in the Parish of Great Bardfield and has been so employed for a minimum period of two years immediately prior to making an application for an Affordable Housing Dwelling.
  3. The prospective occupier of an Affordable Housing Dwelling lives or is employed in the Parish of Great Bardfield and has lived there for a period of less than five years or worked there full time for a period less than 2 years, or is a member of a family (as expression is defined in the Housing Act 1985) of a person who lives in the Parish of Great Bardfield and has done so continuously for a minimum period of five years immediately preceding the application for an Affordable Housing Dwelling.
  4. If there are no prospective occupiers for the Affordable Housing Dwellings who comply with the criteria set out in Paragraphs 1 to 3 above then the criteria and priority order contained in Paragraphs 1 to 3 above shall be applied to a prospective occupier from the parishes of Finchingfield, Little Bardfield, Great Saling, Bardfield Saling, Shalford and Wethersfield.
  5. If there are no prospective occupiers for the Affordable Housing Dwellings who comply with the criteria set out in Paragraph 4 above then the criteria and priority order contained in Paragraphs 1 to 3 above shall be applied to a prospective occupier from the remainder of the administrative district of Braintree.
