This follows a change in government legislation in July 2023 aimed at controlling environmental crime. The new penalties came into effect from 1 February 2024.
We have approved a proposal to increase the fixed penalties for offences committed across the District in relation to littering, fly-tipping, graffiti and breaches of the Household Waste Duty of Care (which requires householders to dispose of waste correctly).
The new penalties are:
- Littering and graffiti: Increased from £100 to £200 (reduced to £150 if paid within 10 days).
- Littering is a criminal offence and carries a fine of up to £2,500 upon conviction in Court.
- Householder Duty of Care: Increased from £300 to £600 (reduced to £450 if paid within 10 days).
- Giving waste to an unlicensed waste carrier is a criminal offence which carries an unlimited fine and a criminal record upon conviction.
- Fly-tipping: Increased from £400 to £1,000 (reduced to £850 if paid within 10 days).
- Fly-tipping is a criminal offence and carries an unlimited fine and/or a custodial sentence, and a criminal record upon conviction.
