2. Contracts - Constitution - Chapter 1, The Articles

2.1. Every contract made by the Council shall:-

2.1.1.  be in writing;

2.1.2.  be signed by a Director in consultation with the Head of Governance or an authorised signatory where a Contract needs to be executed as a deed; and

2.1.3.  comply with the Contract Procedure Rules.

2.2. Without prejudice to the foregoing the Directors may exercise the following functions:-

2.2.1.  Authority to commence a procurement process leading to the award of a contract for works goods or services within approved budgets.

2.2.2.  Authority to waive the requirement to seek tenders or quotations in relation to contracts for works, goods or services below £5,000.

2.2.3.  Authority to approve negotiations with a tenderer submitting the Most Economically Advantageous Tender to obtain improvements in price, delivery or content in relation to contracts for works, goods or services within approved budgets.

2.2.4.  Authority to approve the award of any contract for the procurement of works, goods or services within approved budgets.

2.2.5.  Signing on the Council’s behalf any contract for works, goods or services within approved budgets and in consultation with the Head of Governance.
