6. Excluded Functions - Constitution - Chapter 1, The Articles

6.1. The functions and the work programme of the Scrutiny Committees will not include the following matters:-

6.1.1.  Any matter relating to a decision on a specific planning application;

6.1.2.  Any matter relating to a decision on a specific licensing application;

6.1.3.  Any matter relating to an individual or entity in respect of which that individual or entity has a right of recourse to a review or right of appeal conferred by or under any enactment, including but not limited to:-

6.1.4.  Standards decisions and items which may be brought for decision;

6.1.5.  Breaches of the Constitution;

6.1.6.  Matters relating to the terms and conditions of employment or conduct of individual or groups of staff or Members

6.1.7.  Any matter which is vexatious, discriminatory or not reasonable to be included in the agenda

6.1.8.  Audit process and items which are likely to be considered by the audit process;

6.1.9.  Matters within the proper remit of the Monitoring or S.151 Officers;

6.1.10.  Matters relating to a particular identifiable service recipient or potential service recipient;

6.1.11.  Complaints or matters before the courts or Local Government and Social Care Ombudsman; and

6.1.12.  Contractual matters, other than performance monitoring and review, except with the agreement of the Cabinet.
