2. Composition of Cabinet - Constitution - Chapter 1, The Articles

2.1.  The Cabinet will consist of the Leader of the Council together with at least two but not more than nine other Councillors appointed to the Cabinet by the Leader of the Council, one of whom shall be designated by the Leader of the Council as the Deputy Leader.

2.2.  Only Councillors who are Members of Braintree District Council may be appointed to become Cabinet Members. Subject to the legal minimum and maximum, the size and composition of the Cabinet is a matter solely for the Leader of the Council to decide.

2.3.  From time to time, the Leader may appoint Deputy Cabinet Members, they are members of Cabinet, but with a scheme of delegation which reflects their status as a deputy. They shall be entitled to take such decisions as are delegated to them, and are equal Members at Cabinet meetings.

2.4.  The Leader shall report their appointments or any changes to appointments to the Chief Executive immediately they are made, and following this to the next meeting of the Council.

2.5.  The Cabinet Member designated as Deputy Leader is able to exercise the functions of the Leader of the Council when the Leader of the Council is unavailable. Any exercise of function by the Deputy Leader will be subject to any limitations, qualifications or other instructions as may be issued by the Leader of the Council in writing to the Chief Executive either generally or in relation to the exercise of a particular function.

2.6.  Where a vacancy occurs in the office of Deputy Leader, the Leader of the Council shall appoint another Cabinet Member in their place.

2.7.  The Leader may from time to time appoint a Non-Voting Deputy Portfolio Holder; the Councillor may advise and support the work of the Cabinet and the Portfolio holder. They shall not have executive decision making powers and will not be able to vote at Cabinet meetings. Any Councillor appointed to a Non-Voting Deputy Portfolio Holder role serves until they either resign the role, cease to be a Councillor or the Leader notifies the Chief Executive that their appointment ceases.
