Why we collect your data
Braintree District Council is committed to protecting and respecting your privacy. This privacy notice explains what personal information is collected, what it is used for and who it is provided to, why we require your data, and the legal basis on which we do this.
For the purposes of data protection, Braintree District Council is the data controller for the personal information you provide. All personal information is held and processed by Braintree District Council in accordance with Data Protection legislation.
This privacy notice relates to consultations undertaken by the Environmental Health team for licensing consultations. As part of the Council’s role as responsible authority for taxi and hackney carriage licensing, and Gambling Act and Licensing Act decision making, there may be a need to consult on policies, proposals and decision making processes.
Categories of personal data
The Council will process some or all of the following personal data where necessary to perform its tasks:
• Name
• Address including postcode
• Email address
• Telephone number/s
• IP address that you accessed an online service from.

You are not required to provide any additional data. However, if you do provide it, then we may also keep organisation, position within organisation, and any personal information indicated in your answers, although the Council does ask that you do not provide information that will identify your in any written answers or comments.
Purpose for processing
The information is collected alongside your participation in the consultation to verify the authenticity of the respondents, analyse consultation and engagement activity and communicate information to you in respect of your engagement with the Council on licensing consultations.
Lawful basis for processing personal data
Your personal data will be processed for the purpose of engaging and consulting on licensing decision making. The lawful basis on which your data is processed is under Article 6 (1) (e) – ‘processing is necessary for the performance of a task carried out in the public interest’ or Article 6(1)(c) ‘for compliance with a legal obligation to which the controller is subject.’

Providing accurate information
All of the information we hold is supplied by you when you submit your details as part of your consultation response. If you do not provide your details we will be unable to verify if you are a genuine consultee.
Sharing information
Responses to public consultations may be made publicly available, but will not be attributable to you personally. No personal information which can identify you will be used in producing reports.

Your personal data is intended to be used only by the Licensing Team at Braintree District Council but we may share your information with consultants working with the Licensing team, services within the Council who are responsible for managing engagement activity, or third party public sector organisations who we may be working in partnership with.
Data retention
We will only keep your data for as long as is necessary in accordance with the Council’s Data Retention Scheme. We may hold any information provided by you as part of engagement or consultation activity for up to six years following the closure of the consultation.
