Accompanying note to the Confirmed Diversion Order
On 29th June 2024 Braintree District Council confirmed the above Order.
The effect of the Order as confirmed is to divert the length of Footpath 4 Gestingthorpe, which commences from a point approximately 15 metres from its junction with Delvyns Lane, Gestingthorpe in a westerly direction for a distance of approximately 61 metres to the parish boundary between Gestingthorpe and Castle Hedingham where it continues as Footpath 19 Castle Hedingham for a distance of approximately 43 metres and to create an alternative Footpath 4 Gestingthorpe, which commences from the unaffected length of Footpath 4, turning in a northerly direction along the track with a width of 3 metres for a distance of approximately 52 metres where it turns in a south-westerly direction and continues with a width of 2 metres along the north side of the fence boundary for a distance of approximately 63 metres to the parish boundary, where it continues as an alternative Footpath 19 Castle Hedingham, with a width of 2 metres, in a south-westerly direction along the north side of the fence boundary for a distance of approximately 41 metres where it turns in a southerly direction along the western side of the fence boundary for a distance of approximately 4.4 metres to join the unaffected length of Footpath 19 Castle Hedingham as shown on the Order Map.
A copy of the confirmed Order and the Order Map may be seen free of charge at Braintree District Council Offices at Causeway House, Bocking End, Braintree, Essex, CM7 9HB between 9.00am and 5.00pm Monday to Friday. Copies of the Order and Order Map may be obtained free of charge.
The Order comes into force on the date on which Braintree District Council certifies that the terms of Article 2 of the Order have been complied with, but if a person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the above Act, or on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the to the confirmation of the Order, they may apply to the High Court for any of those purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from 4th July 2024 as required by paragraph 7 of Schedule 14 to the Act.
