Houses in Multiple Occupation management regulations

All Houses in Multiple Occupation (HMO) fall under The Management of Houses in Multiple Occupation (England) Regulations 2006. The regulations apply to both HMOs that need a licence and those that don't.

The regulations make sure HMO owners and managers control a range of health and safety risks such as:

  • fire safety by maintaining equipment and making sure there is a safe route of escape
  • the repair, maintenance and cleanliness of communal areas including gardens
  • the repair and maintenance of fixtures, fittings and appliances in communal areas
  • providing services including water, drainage, electricity and gas
  • providing and managing waste disposal facilities

Badly managed HMOs:

  • put residents at risk
  • encourage anti-social behaviour
  • can have a negative impact on an entire neighbourhood

If a landlord or owner is found breaches management regulations, they can receive a fine for each separate offence. This may result in substantial financial penalties.

Section 257 HMOs

There are separate regulations for buildings that:

  • were converted into flats prior to the 1999 Building Regulations and
  • short term tenancies are in place for more than one-third of the flats
