Braintree District Local Plan Review Adopted 25th July 2005 *

 

** Please note that a number of policies in the Adopted Local Plan Review have expired or been superseded since its adoption in 2005. The Core Strategy is accompanied by the Proposals Map, which replaces the Local Plan Review Proposals Map. Further details are given below.  Changes brought about by the adoption of the Core Strategy will be indicated in the interactive version of the plan in due course.**

The Core Strategy Development Plan Document (DPD) was adopted by the Council on 19th September 2011, subject to a 6 week legal challenge period.

The Core Strategy DPD forms part of the Local Development Framework.  It sets out the spatial vision, spatial objectives and strategy for the development of the District up to 2026. All subsequent Development Plan Documents will need to be in conformity with the Core Strategy.  This Development Plan Document covers all of the area administered by Braintree District Council. 


List of Braintree Local Plan Review (RLP) Policies superseded by Core Strategy Policies (listed in Core Strategy Appendix 1):

- RLP1 Housing Provision replaced by Policy CS1 Housing Provision and Delivery
- RLP5 Affordable Housing in New Development replaced by Policy CS2 Affordable Housing

- (Policy CS3 Gypsies and Travellers and Travelling Showpersons does not replace an existing policy, as RLP 23 Provision for Gypsies and Travelling Showpersons had not been saved.)

- RLP 78 Countryside replaced by Policy CS5 The Countryside
- RLP110 Retail and Town Centre Development - The Sequential Approach and RLP111 Retail Development replaced by Policy CS6 Town Centre Regeneration and Retailing
- RLP60 Braintree Branch Line Improvement and RLP61 New Road Schemes replaced by Policy CS7 Promoting Accessibility for All
- RLP79 Special Landscape Areas and RLP88 Agricultural Land replaced by Policy CS8 Natural Environment and Biodiversity
- RLP 137 Open Space Standards and RLP 139 Allotments replaced by Policy CS10 Provision for Open Space, Sport and Recreation
- RLP163 Infrastructure and Community Facilities replaced by Policy CS11 Infrastructure, Services and Facilities

The Core Strategy is accompanied by the Proposals Map, which replaces the Local Plan Review Proposals Map.

Eleven Local Plan Review Policies Expired on 24.7.08

Government Regulations, relating to the Planning and Compulsory Purchase Act 2004, dealing with the transition from Local Plans to Local Development Frameworks, state that Local Plan policies are only automatically ‘saved’, that is, in force, for three years after the date of adoption of the plan. This three year period ended on 24.7.08 in respect of the Braintree District Plan.

The Secretary of State for Communities and Local Government decided that the majority of the Braintree District Local Plan Review policies could be ‘saved’ and should continue to apply after 24.7.08, with the exception of the following eleven policies, which expired on that date.

RLP43 Atlas Works Site, Earls Colne
RLP57 Freeport Special Policy Area
RLP66 Flood Risk in Developed and Urban Areas
RLP67 Flood Risk in Undeveloped Areas
RLP68 Functional Floodplains
RLP130 Indoor Sport and Leisure Site, Braintree Retail Park
RLP131 Swimming Pool, Millennium Way, Braintree
RLP132 Community Swimming Pool, Ramsey School, Halstead
RLP156 Community Uses Site, Colchester Road, Halstead
RLP165 Monitoring

All of the plan, except for the eleven policies which expired on 24.7.08, is ‘saved’ and will continue to remain in force until it is replaced in whole, or part by approved policies in the Core Strategy and Development Management Documents, which will replace the Local Plan Review in due course.


Amendments to Appendices:

The parking standards at Appendix 3 of the Local Plan Review have been superseded by revised  Parking Standards that were adopted by the Council in November 2009.

County Wildlife Sites (Appendix 6 of the Local Plan Review) are now called Local Wildlife Sites -  Reviewed List

Inspector's Report:
The Inspector's Report on objections to the Local Plan Review was received by the Council on 20th December 2004.  This sets out Mr Braithwaite's recommendations on each of the objections.  This is in three parts: a covering letter, Part One dealing with policy objections and Part Two with site specific objections.

In his report, the Inspector refers to the Local Plan Review, which is made up of the Revised Deposit Plan, plus changes made to the Plan in the Pre-Inquiry Changes and Council's Concessions made during the Local Plan Inquiry.  These three documents have been combined into one, in order to make it easier to refer to the Local Plan Review, as it stood at that time.  This combined document is set out here:

The Inspector's recommendations were considered by the Council's Regulatory Committee on 26th January 2005 and by Full Council on 16th February 2005.  The Council accepted all of the Inspector's recommendations.
