Section 38 (6) of the Planning and Compensation Act 2004 states
that:
"If regard is to be had to the development plan for the purpose
of any determination to be made under the planning Acts the
determination must be made in accordance with the plan unless
materials considerations indicate otherwise".
In the case of Braintree District Council, the development plan
is made up of the
Essex and Southend-on-Sea Structure
Plan and the
Braintree District Local Plan Review.
The Braintree District Local Plan Review was adopted by the
Council on 25th July 2005 and it provides a framework for the
development of the Braintree District. The
Braintree District Local Plan Review and the policies
and plans contained therein, is available to view online.
Alternatively, a copy can also be viewed during office hours at
Causeway House.
Similary, the
Essex and Southend-on-Sea Structure
Plan can also be viewed online.
