6. Scheme of Delegation *

The majority of applications are determined under Delegated Powers by the Development Director, in accordance with the scheme of delegation, as amended on 20th April 2006 by Full Council.  In general, under this scheme all applications will be determined under Delegated Powers unless: -

- 5 or more letters of representation have been submitted that are contrary to the planning officers recommendation, in the case of applications for householder extensions, changes of use, listed building consent, conservation area consent or advertisement consent; or

- 1 or more letters of representation have been submitted that are contrary to the planning officers recommendation, in the case of planning applications relating to applications for major residential or commercial/industrial development or for telecommunications development, or for minor residential development;

- The Parish or Town Council representation is contrary to the planning officers recommendation;

- An elected Member ‘calls in’ an application and asks for it to be referred to an Area Committee.  (This needs to be in writing with reasons given and on planning grounds.  Any Member is able to refer an application to an Area Committee in this way).

…In which case, the application would be referred to an Area Planning Committee for consideration.  Members of the public, organisations, amenity societies or Parish or Town Councils who submitted representations on an application that has to be referred to an Area Committee for consideration, will be notified in writing of the date and venue of the Committee in advance of the meeting.

However, please note the following: -

- Notwithstanding the above, an application can be reported to an Area Committee if the Head of Planning Control in consultation with the Chairman of the respective Area Committee considers that an application is sufficiently controversial to warrant a report and recommendation to Committee.

- If an application is contrary to the Development Plan and would result in a recommendation for refusal, the receipt of any number of contrary third part representations of support (including from Parish and Town Councils) would not necessitate the application having to be reported to an Area Committee for a decision.
