The existing Enforcement Policy was drawn up in 1998 and fails to
adequately reflect the Environmental Services Departments current
enforcement practices, which have developed through the
introduction of new legislation and central government guidance. A
recent audit of the existing policy against "Best Value Performance
Indicator BV 166", revealed that there were a number of areas where
the policy was deficient.
The new Policy, formally adopted in July 2002, has been drafted
in-line with guidance provided by DETR and the Chartered Institute
of Environmental Health Officers. To view a copy of the Policy

CONSULTATION
Many of the principles detailed in the policy are already in
practice, as they are part and parcel of the legislative
provisions, which guide enforcement. The intention is to publish
the written policy so that it can serve as a point of reference for
legal challenge and to provide a clear statement of intent for any
person or business that may find themselves in breach of
environmental legislation.
In addition, by publishing the policy we wish to seek your
comments. If after reading the policy could you please take a few
moments to pass on your comments by e-mail to,

We would be grateful if you could comment on the following;
Is the policy easy to read and understand? After reading the policy
are you clear on the various levels of enforcement. Do you think
the policy is too harsh/just right or too weak? Are there any
omissions or points that require further clarification? Have you
any additional comments to make?
