Any person who is eligible to hold a premises licence can complete
an
application
form for an existing Premises Licence to be transferred to
them. This must be accompanied by the fee and the existing
licence or a statement with reasons as to why the licence cannot be
provided.
On the same day you give the application to the Licensing
Authority, you must provide the Police with a copy
of the application and accompanying documents. If the Police
consider that the transfer will undermine the crime prevention
objective they can object within 14 days.
With the consent of the existing licence holder you can ask for
the transfer to have immediate effect on an interim basis while the
application is being determined. You may be exempted from the
requirement to obtain consent if you can prove you have taken all
reasonable steps to obtain it and you will be in a position to
provide the regulated activities at the premises during the
application period.
Decision making
The transfer must be granted if you meet the conditions above
and there is no police objection, however if there is the Licensing
Committee will hold a hearing to determine the application.
Notifications
When an application is given interim effect and on final
determination if the existing licence names a designated premises
supervisor the applicant must notify that person (unless they are
the same person).
