A premises licence lapses if the holder dies, becomes mentally
incapable or insolvent. This could cause a business to close,
however, to permit regulated activities to continue whilst a
transfer application is being prepared an Interim Authority
Notice can be served on the Licensing Authority.
Only one Notice can be served which must be done within 7 days
of the licence lapsing by:
The freeholder or leaseholder of the premises
By the licence holders personal representative (following the
death of the licence holder)
The holder of an Enduring Power of Attorney (following mental
incapacity of the licence holder)
The insolvency practitioner of the former licence holder
(following insolvency)
The interim authority will lapse if within 7 days the chief
officer of police has not been notified and a transfer application
has not been submitted
Where there are police objections on the grounds of crime
prevention a hearing will be held, by the Council's licensing
committee.
A fee is payable to the Licensing Authority.
